Shaykh Ṣāliḥ al-Fawzān’s حفظه الله Explanation of the Athar: ʾĀyah of Stoning

Within the Ṣaḥīḥayn, there’s an Athar narrated from the righteous Companion & second Caliph of Islām, ʿUmar ibn al-Khaṭṭāb رضي الله عنه, regarding the Ḥudūd (capital punishment) of stoning. In this Athar, ʿUmar ibn al-Khaṭṭāb رضي الله عنه affirms the act of stoning those deserving & attested to it being from the Sunnah of The Prophet ﷺ, though fearing people would treat it as otherwise.

Herein, we’ll be looking into this Athar’s concise explanation by the honorable Shaykh; Shaykh Ṣāliḥ ibn Fawzān ibn ʿAbdullāh al-Fawzān حفظه الله, one of the major & most senior scholars alive today. May Allāh preserve & protect him.


ʿUmar ibn al-Khaṭṭāb رضي الله عنه said:

The ʾĀyah of stoning was revealed so we comprehended and memorized it, and Allāh’s Messenger ﷺ stoned. I am afraid that after a long time has passed, people would say ‘we do not find stoning in the Book of Allāh.’ Certainly, it is in the Book of Allāh.

Shaykh Ṣāliḥ al-Fawzān حفظه الله commentated: “He (ʿUmar) is referring to the statement of Allāh The Most High:

وَالشَّيْخُ وَالشَّيْخَةُ إذَا زَنَيَا فَارْجُمُوهُمَا البَتَّةَ نَكَالاََ مِنَ الله وَالله عَزِيزٌ حَكِيمٌ
The mature (i.e., married) man and woman, when they commit illegal sexual intercouse, stone them to death – a punishment from Allāh. And Allāh is Mighty and Wise.

This is the Qurʾān whose wording has been abrogated but the ruling remains. Allāh’s Messenger  stoned and ordered stoning, and the Muslims are unanimous on that. No one disagress with it except the people of innovations whose disagreement is not given any consideration like the Khawārij.

Therefore, stoning to death is confirmed by the Qurʾān, the practical and verbal Sunnah, and the Ijmāʿ of the Muslims. So, whosoever denies it is a disbeliever because he is a denier of Allāh, His Messenger , and the Ijmāʿ of the Muslims. Stoning is authentically confirmed, therefore there is no room for discussion therein.”

May Allāh protect Shaykh Ṣāliḥ al-Fawzān & reward him for his many contributions to the religion of Islām.
